2. Eligibility

By using our Services, you grant Swapnobiz a limited, non-exclusive, royalty-free licence to host, store, process, display, and transmit your content solely for the purpose of providing and improving the Services.

You represent that you have all necessary rights and permissions to upload and use such content.

6. Intellectual Property

All trademarks, logos, software, source code, platform features, designs, graphics, documentation, and other intellectual property owned by Swapnobiz remain the exclusive property of Swapnobiz or its licensors.

Except as expressly permitted, you may not copy, modify, reproduce, distribute, sell, lease, sublicense, or create derivative works from our intellectual property without prior written permission.

7. Subscription, Billing & Payments

Where applicable:

• Subscription fees must be paid in advance.
• Prices are subject to change with reasonable prior notice.
• Applicable taxes, including GST, will be charged where required by law.
• Failure to make timely payments may result in suspension or termination of Services.
• Auto-renewing subscriptions will renew until cancelled before the renewal date.

8. Refund & Cancellation

Refunds and cancellations are governed by our separate Refund & Cancellation Policy, available on our website.

Certain services—including domain registration, hosting, custom development, third-party licences, SMS credits, WhatsApp services, and activated digital products—are generally non-refundable unless required by applicable law.

9. Data Privacy & Protection

Your use of our Services is also governed by our Privacy Policy.

Swapnobiz processes personal data in accordance with the Digital Personal Data Protection Act, 2023 (India) and other applicable laws. We implement reasonable technical and organisational measures to protect your information.

12. Limitation of Liability

To the fullest extent permitted by law, Swapnobiz shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, or data arising from the use of our Services.

Where liability cannot be excluded by law, our aggregate liability shall not exceed the total amount paid by you for the relevant Service during the twelve (12) months immediately preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Swapnobiz, its directors, officers, employees, affiliates, partners, and licensors from any claims, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from:

• Your misuse of the Services.
• Your violation of any law or third-party rights.
• Content submitted or published through your account.

14. Suspension & Termination

We may suspend or terminate your account immediately if:

• You violate these Terms.
• You fail to pay applicable fees.
• Your activities threaten the security or integrity of our platform.
• We are required to do so by law or a competent authority.

Upon termination, your right to use the Services will cease. Certain obligations, including payment obligations and provisions relating to intellectual property, confidentiality, and liability, will survive termination.

We may introduce, modify, replace, or discontinue features, products, or Services at any time to improve functionality, security, compliance, or user experience.
